This Privacy Policy explains how IXTY9 LLC (“IXTY9,” “we,” “our,” “us”) collects, uses, shares, and protects information when you visit our websites, use our products and services, interact with Ixty AI, participate in our community, or communicate with us. It applies to:

• App iXty9 platform and related integrations
• Ixty AI (our assistant) and related interfaces

2. Scope and Roles

• For website visitors, community members, and direct users of Ixty AI or IXTY9 services, IXTY9 is the “controller” of your personal information.
• For business customers using App iXty9 or other IXTY9 services to process their own end users’ data, IXTY9 acts as a “processor/service provider.” We process data per your instructions and our agreement. A Data Processing Addendum (DPA) is available upon request at [email protected] .

3. Information We Collect
   We collect information in three ways: you provide it, we collect it automatically, and we receive it from third parties.

A. Information You Provide

• Identity and Contact: name, job title, employer, email, phone, address
• Account and Profile: username, password, preferences, roles, photo/avatar
• Communications: support requests, survey responses, chat or email content, Ixty AI prompts and feedback
• Transactions: order details, billing address, limited payment details (we use payment processors; we do not store full card numbers)
• Content: files, images, audio/video, event submissions, live stream participation, UGC
• Professional/Business: industry, use cases, integrations, app configurations

B. Information Collected Automatically

• Device/Usage: IP address, device IDs, browser type, OS, settings, language, referring/exit pages, clickstream, timestamps, pages viewed, feature usage
• Cookies/Tracking: cookies, pixels, tags, SDKs, beacons, session replay where applicable
• Location: general location from IP; with consent, precise location via device settings
• Communications Metadata: delivery/read receipts, message routing, frequency

C. Information From Third Parties

• Integrations and partners (e.g., email/calendar, CRM/accounting tools you connect)
• Analytics, advertising, and measurement partners
• Public sources and social networks (if you interact with our pages or sign in via social)
• Affiliates and referral partners

Special Categories/Sensitive Data
We do not seek to collect sensitive personal information (e.g., health, biometric, precise geolocation) unless necessary for a specific feature and with appropriate notice/consent. Do not submit Protected Health Information (PHI). IXTY9 is not HIPAA compliant at this time.

AR/VR and Media
If you use our AR/VR or LIVE! streaming features, we may process camera/microphone input, spatial data, and recordings to deliver services (e.g., rendering, moderation, distribution).

4. How We Use Information
   We use information to:

• Provide, operate, and secure our Services
• Create and manage accounts, authenticate users, and process transactions
• Deliver communications (service notices, updates, security alerts)

• Input Content: We process prompts, files, and outputs to provide responses, safety checks, and quality assurance.

• Third-Party Model Providers: Where used, we implement contractual, technical, and organizational safeguards. We restrict providers from using your data for their own training.
• Safety/Moderation: We may automatically scan content for abuse, malware, and policy violations.

   We use cookies and similar technologies for:

• Advertising and measurement (including cross-site “share” for targeted ads, where permitted)

   By providing a phone number or email, you consent to receive messages regarding your account, transactions, and services. Marketing messages require consent where required by law. SMS: Message and data rates may apply. Message frequency varies. Reply STOP to opt out; HELP for help. Carrier is not liable for delayed or undelivered messages.

8. How We Share Information
   We may share information with:

• Service Providers/Processors: hosting, cloud, analytics, communications, payments, security, customer support, integrations
• Business Customers: if you use App iXty9 through a business customer, your data may be accessible to that organization per its policies
• Partners and Affiliates: for joint offerings, referrals, or integrations (with notice/consent as required)
• Advertising/Analytics Partners: for measurement and targeted advertising where permitted; you can opt out as described below
• Professional Advisors: lawyers, auditors, insurers
• Legal/Compliance: to comply with law, enforce terms, protect rights, safety, and security
• Business Transfers: in connection with a merger, acquisition, financing, or sale of assets (we will notify you where required)

We do not sell personal information for money. Under some U.S. state laws, sharing data for targeted advertising may be considered a “sale” or “share.” See Your Privacy Rights.

9. Data Retention
   We retain personal information for as long as needed to provide services, comply with legal obligations, resolve disputes, and enforce agreements. Criteria include account status, legal requirements, and the nature of the data. We may retain de-identified or aggregated data.

10. Security
    We use administrative, technical, and physical safeguards designed to protect personal information, including access controls, encryption in transit, monitoring, and regular reviews. No system is 100% secure; please use strong passwords and enable available security features.

11. International Data Transfers
    We are based in the United States and may transfer information to the U.S. and other countries that may have different data protection laws. For EEA/UK residents, we use appropriate safeguards (such as Standard Contractual Clauses) where applicable.

15. Children’s Privacy
    Our Services are not directed to children under 13 (or under 16 where applicable). We do not knowingly collect personal information from children. If you believe a child provided data, contact us and we will take appropriate action.

16. Community, Events, and Media

• If you join the iXty9 Community or attend/appear in events or LIVE! streams, your name, likeness, handle, and content may be displayed, recorded, and distributed according to event or platform settings and applicable releases.
• Respect others’ privacy and follow community guidelines. Content you choose to make public may be indexed or reshared.

17. Third-Party Links and Services
    Our Services may link to third-party sites, apps, or services. Their practices are governed by their own policies. We are not responsible for their privacy or security practices.

18. Payment Processing
    Payments are processed by third-party processors. We receive limited information (e.g., last four digits, status) and do not store full payment card numbers.

19. De-Identified and Aggregated Data
    We may create and use de-identified or aggregated data for analytics, research, and product improvement. We take reasonable measures to prevent re-identification and will not attempt to re-identify such data.

20. No PHI / HIPAA Notice
    IXTY9 is not HIPAA compliant. Do not submit or store Protected Health Information (PHI) in our Services.

21. Changes to This Policy
    We may update this Policy from time to time. The “Effective” date indicates the latest version. Material changes will be notified via the Services or by email where required. Your continued use after changes means you accept the updated Policy.
